These Terms of Service (the "Terms") are a binding agreement between you and SecOne Inc., a Delaware C Corporation, which owns and operates the Signatoro web application and related services available at signatoro.com (together, the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you confirm that you have authority to bind that organization, and "you" includes it.
If you do not agree to these Terms, do not use the Service.
Signatoro is an email signature generator: it lets people, and AI assistants acting on their behalf, create, manage and deploy email signatures. It is offered as a subscription software service. We may add, change or remove features over time. We will give reasonable notice of changes that materially reduce the Service's core functionality, where practicable through the Service itself or by email to the address on your account.
The Service is offered to businesses and to individuals acting in a professional capacity. You must be at least 18 years old to use it.
You retain ownership of the data, documents and other material you upload to or create in the Service ("Your Content"). You grant SecOne Inc. a non-exclusive, worldwide, royalty-free licence to host, store, process, transmit and display Your Content solely to provide, secure and improve the Service and as otherwise permitted by our Privacy Policy. You are responsible for having the rights needed to use Your Content with the Service and for its legality.
You agree not to:
The Service, including its software, design, text, trademarks and logos, is owned by SecOne Inc. or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. If you send us feedback or suggestions, we may use them without obligation to you.
The Service relies on third-party providers, including cloud hosting, payment processing and email delivery, and may link to or integrate with services you choose to connect. We are not responsible for third-party services, and your use of them is governed by their own terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, SECONE INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. Nothing in the Service is legal, financial or other professional advice.
TO THE FULLEST EXTENT PERMITTED BY LAW, SECONE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THAT PERIOD, OR ONE HUNDRED US DOLLARS (US$100) IF YOU PAID NOTHING. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You will defend and indemnify SecOne Inc. against claims, damages and costs (including reasonable legal fees) arising from Your Content, your use of the Service in breach of these Terms, or your violation of any law or third-party right.
You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service, in which case we will give reasonable notice and a way to export Your Content where practicable. Sections 5, 7 and 9 through 14 survive termination.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of these Terms or the Service, and each party consents to that jurisdiction. Before filing a claim, you agree to contact us at the address below and to try in good faith to resolve the dispute informally for 30 days. Nothing in this section limits rights you have under mandatory consumer law in your country of residence.
We may update these Terms from time to time. Material changes will be announced through the Service or by email at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.
These Terms and the Privacy Policy are the entire agreement between you and SecOne Inc. about the Service. If any provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. Our failure to enforce a provision is not a waiver.
